Terms of Service

These are the terms you agree to when you book a build or start a monthly plan with me. Plain English, and short - a long contract nobody reads protects nobody.

Who you're contracting with

The Third Coconut is a trading name of AadhiPixels Ltd, a company registered in England & Wales (company no. 16230492). I am not currently VAT-registered, so no VAT is charged. If that changes I'll tell you before it affects your invoices. Reach me at hello@thethirdcoconut.com.

These terms are for businesses. They aren't a consumer contract, so the 14-day consumer cancellation right doesn't apply - the cancellation terms below are what you get instead, and they're deliberately generous.

What you're buying

Two shapes, and they bill differently:

  • A build, paid once. A fixed scope agreed in writing before anything starts, for a fixed price.
  • A plan. A setup fee up front, then a monthly that covers hosting, care, updates and support for as long as it runs. Hub is £149 + £49/month, Grow £499 + £129/month, Complete £899 + £229/month. The current figures are always on the packages page; if they differ from these, the packages page is right and I've been slow updating this one.

Anything outside the agreed scope is a separate quote. I won't do extra work and then invoice you for it as a surprise.

Paying

Card payments run through Stripe. Bank payments and monthly plans run through GoCardless Direct Debit. Neither of them gives me your card or account details - I only see that a payment succeeded.

The setup fee is due before work starts. Monthly payments are collected in advance on the same date each month. Invoices for one-off work are due within 14 days unless we agreed otherwise in writing.

Direct Debit

When you start a monthly plan you set up a Direct Debit mandate through GoCardless, which is authorised by the Financial Conduct Authority. Payments appear on your statement as GOCARDLESS re AadhiPixels Ltd.

I'll give you at least three working days' notice by email before the first collection, and before any change to the amount or the date.

The Direct Debit Guarantee. This Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits. If there is a change to the amount, date or frequency of your Direct Debit, AadhiPixels Ltd will notify you three working days in advance, or as otherwise agreed. If an error is made in the payment of your Direct Debit, by AadhiPixels Ltd or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society. If you receive a refund you are not entitled to, you must pay it back when AadhiPixels Ltd asks you to. You can cancel a Direct Debit at any time by contacting your bank or building society - written confirmation may be required. Please also tell me.

Cancelling, and refunds

  • Monthly plans: 30 days' notice, any time. No minimum term, no exit fee. Email me and the next collection after the notice period is the last one.
  • Before work starts: a full refund of anything you've paid, no questions.
  • Once a build is under way: I refund the part I haven't done. You keep everything delivered up to that point.
  • Setup fees cover work already carried out once the build has started, so they aren't refundable after that - but see the line above about work not yet done.
  • If something went materially wrong on my side, email me before anything else. I'd rather fix it or refund it than have you chase a chargeback.

What happens to your website if you leave

Your domain is yours and always was - it stays registered to you and I'll transfer it on request, at no charge. Your content and images are yours. Once the build is paid for in full, you own the rights to the design and content I made for you.

While a plan is running, hosting is part of it, so the site comes down 30 days after the plan ends unless you arrange to move it. I'll hand over an export and help you move if you ask. I don't hold a site hostage.

What I need from you

Projects stall on content far more often than on code. I need copy, images, logins and timely feedback. If a project goes quiet for more than 60 days I may invoice for work completed and close it; picking it up again later is fine and I won't charge you twice for the same work.

What I promise, and what I don't

I'll do the work with reasonable skill and care, and keep sites I host as available as I reasonably can. I don't promise a site will never be down - it runs on third-party infrastructure and pretending otherwise would be a lie.

I can't promise search rankings, a number of leads or a level of sales. Anyone who does is guessing. What I do promise is that the numbers I quote you are honest and the pass-through costs carry no markup.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't lawfully be limited. Subject to that, my total liability in any 12-month period is limited to what you paid me in that period, and I'm not liable for lost profits or lost business.

Your data

How I handle personal data - yours, and your customers' - is in the privacy notice, which forms part of these terms. Where I host a site or portal for you and hold data about your customers, I act as your processor and only on your instructions.

The legal bits

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If a clause turns out to be unenforceable the rest still stands.

I'll give at least 30 days' notice by email before a material change takes effect. If a change doesn't suit you, cancel before it applies.
